Afinado Music – Terms of Service, Privacy Policy, and App Usage Rules

1. Acceptance of Terms

By creating an account or using Afinado Music (“we,” “us,” “our”), you agree to be bound by these Terms of Service, our Privacy Policy, and the App Usage Rules. If you do not agree, do not access or use our app or website.

2. Who We Are

Afinado Music is a California-based limited liability company (LLC) providing a digital platform for booking live music entertainment. We operate solely as a marketplace; we do not directly hire, manage, endorse, or supervise musicians or bands.

3. User Roles

  • Clients: May search for and book musicians/bands.

  • Musicians/Bands: May create profiles and accept bookings.

You are solely responsible for your interactions, communications, and agreements with other users.

4. Eligibility

You must be at least 18 years old and reside in the United States to use Afinado Music. By using the platform, you confirm you are legally able to form binding contracts under applicable law.

5. Booking & Payment Terms

  • Payments are processed via Stripe. We do not store payment credentials.

  • A confirmed booking constitutes a binding agreement between the Client and the Musician/Band.

  • Afinado Music is not liable for cancellations, no-shows, or contract breaches by either party.

  • Overbooking or false bookings will result in immediate suspension or termination of your account.

6. Cancellations and Refunds

  • All cancellations are governed by the individual contract between Clients and Musicians/Bands.

  • Afinado Music does not issue refunds directly. Disputes should be resolved between the parties involved.

  • Clients may report fraudulent or unresolved disputes for administrative review, but we are not obligated to act as an arbitrator.

7. Fake Accounts & Misuse

Afinado Music strictly prohibits:

  • Fake, duplicate, or impersonation accounts

  • Fraudulent bookings

  • Spam, harassment, or abusive language in chat

  • Circumvention of our payment or contract systems

Violations will result in immediate account termination and may be reported to law enforcement.

8. Privacy Policy

a. Information We Collect

  • Name, contact info, user role, and content you upload

  • Location data (for discovery)

  • Chat communications (encrypted)

  • Booking and payment history

b. How We Use It

  • To provide core services (search, bookings, contracts, communication)

  • To improve features and protect users from fraud

  • For legal and security purposes

c. Sharing of Data

  • We do not sell your data.

  • We share information with service providers (e.g., Apple, GooglePlay) strictly to operate the app.

d. California Privacy Rights (CCPA)

9. Intellectual Property

All branding, code, design, and platform content are owned by Afinado Music LLC. You may not reproduce, reverse engineer, or repurpose our content without written permission.

10. Disclaimers & Limitation of Liability

  • Afinado Music is a facilitator and not a party to the contracts between users.

  • We do not guarantee the accuracy, quality, or performance of any Musician, Band, or Client.

  • We are not liable for lost profits, event issues, or personal injuries arising from bookings.

To the fullest extent permitted by law, our total liability shall not exceed the amount paid by you to us in the past 12 months.

11. Indemnification

You agree to indemnify and hold harmless Afinado Music LLC, its officers, agents, and affiliates from any claims, damages, or losses arising from your use of the platform, violation of these terms, or any dispute between you and other users.

12. Account Termination

We may suspend or terminate accounts that violate these terms, without prior notice, at our sole discretion. Users may also delete their accounts at any time through the app settings or by contacting support.

13. Dispute Resolution

You agree that:

  • Disputes with other users are your responsibility.

  • Disputes with Afinado Music LLC will be resolved via binding arbitration in Santa Clara County, California.

  • You waive the right to participate in class-action lawsuits or jury trials.

14. Modifications

We may update these Terms and Policies periodically. Continued use of the app constitutes acceptance of the new terms.

16. App Rules

All users of Afinado Music must follow these rules to maintain a respectful, reliable, and secure platform. Violations may lead to suspension, permanent ban, or legal action.

Allowed Behavior

You may:

  • Create one verified account as a Client, Musician, or Band.

  • Send genuine booking requests and communicate respectfully via in-app chat.

  • Upload accurate and professional profile information, pricing, and availability.

  • Only accept or offer bookings you intend to honor.

  • Use contracts and signatures within the platform for all agreements.

  • Report inappropriate content or conduct through our in-app tools or contact email.

Prohibited Behavior

The following activities are strictly prohibited:

Fake or Fraudulent Use

  • Creating fake, duplicate, or impersonated profiles

  • Posting misleading bios, fake reviews, or altered videos/sound

  • Booking with no intent to follow through ("ghosting" or "baiting")

Bypassing the Platform

  • Attempting to book or pay outside of Afinado Music to avoid fees

  • Sharing personal contact or payment information before a confirmed booking

Harassment or Abuse

  • Sending threatening, obscene, or offensive messages

  • Pressuring users into accepting bookings or discounts

  • Retaliating after receiving a negative review

Unprofessional Conduct

  • Showing up late, intoxicated, or unprepared to an event

  • Canceling last-minute without a valid reason or notice

  • Requiring additional unlisted fees or breaching agreed contract terms

Overbooking or No-Shows

  • Clients: Submitting multiple booking requests to different artists for the same date without intent to confirm only one

  • Musicians: Accepting overlapping bookings or failing to appear for a confirmed gig

Technical Misuse

  • Attempting to hack, copy, or reverse engineer our app

  • Using bots or scraping tools to collect data from the platform

  • Uploading malicious files or code

Violations & Enforcement

Afinado Music may:

  • Investigate user behavior at our sole discretion

  • Suspend, ban, or permanently remove accounts with no refund

  • Share evidence with law enforcement where applicable

  • Retain evidence (chats, IPs, contracts, etc.) for investigation

User Responsibilities

  • Keep your login credentials secure

  • Monitor your booking calendar to avoid conflicts

  • Report suspicious or abusive activity immediately
